Agreement
These Terms of Service (“Terms”) are an agreement between you and Build or die (“BOD,” “we,” “us,” or “our”). They govern your use of build-or-die.ai, the BOD macOS app, Season Authority, Build Seasons, AI Coach, Prompt Artifacts, and related services.
By creating a Builder Identity, using BOD, or buying a Build Season, you agree to these Terms and the Privacy Policy. If you do not agree, do not use BOD. You must be at least 18 years old and able to enter a binding contract, or use BOD for an organization with authority to bind that organization.

BOD is a product companion for Builders. It uses connected, traceable evidence to show a simple Daily Brief, one Main Quest, an expected signal to observe, Prompt Artifacts you may copy, and a retrospective. A Build Season is a fixed-duration attempt at a defined commercial Stage.
BOD is not a development agency, advertising service, financial adviser, legal adviser, tax adviser, investment adviser, autonomous coding agent, or guarantee of product-market fit. You remain responsible for your product, customers, pricing, claims, code, security, deployments, business decisions, and compliance obligations.
Builder Identity and account security
You must provide accurate information, keep your Google and device accounts secure, and notify us if you suspect unauthorized access. One Builder Identity may be used across your authorized devices. You may not sell, rent, transfer, or share an account in a way that defeats identity, purchase, evidence, or Season controls.
Google sign-in proves your Builder Identity only. It does not connect Google Analytics, Search Console, Drive, advertising, or another Google product. Optional data sources require a separate connection and permission.
Build Seasons
Day 0 and the start date
Payment unlocks Day 0 setup. It does not automatically start the Season. Day 1 begins only after the required evidence source passes its defined readiness check and you lock the Stage Contract, including its target, evidence definition, time zone, deadline, exclusions, and Boss Gate.
First Dollar Season
The First Dollar Season is a fixed 30-day attempt. Its Boss Gate is one live, net-positive customer payment that is not self, internal, or test and remains eligible after the settlement period shown before checkout. The exact offer, settlement period, terms version, refund policy version, and restart policy version displayed at checkout and locked to your purchase control if they differ from this summary.
Results and progress
Only contract-approved Outcome Evidence can satisfy a Boss Gate. Commits, deployments, visits, completed Quests, streaks, XP, AI output, and Builder attestations may describe work but do not themselves prove a commercial result. If a Season is Lost, the next Stage stays locked. Any restart requires a new, explicit purchase after the stated cooldown; there is no automatic renewal or automatic retry.
No commercial outcome is guaranteed. A Daily Brief and Expected Signal are a plan and a hypothesis to test, not a promise of revenue, users, traffic, rankings, conversion, or product-market fit.
Payment, renewal, taxes, and refunds
Build Seasons are one-time purchases unless checkout clearly states otherwise. BOD does not automatically renew a Season. Prices, taxes, currency conversion, payment methods, and transaction terms are displayed by Lemon Squeezy or the payment provider at checkout.
You authorize the payment provider to charge the amount shown at checkout. You are responsible for applicable taxes except where the payment provider collects them. Provider terms may also apply to the transaction.
A Lost Season, missed Quest, lack of revenue, or dissatisfaction with a recommendation is not by itself a refund reason. Refunds remain available where required by law, for duplicate charges, non-delivery, a major product failure, or when required by the payment provider’s rules. A full refund or charge reversal may revoke the associated entitlement and access to the paid Season.
Connected services and evidence
You may connect services such as GitHub, a local repository, a payment provider, PostHog, Google Analytics, Google Search Console, or Browser Work Context. You represent that you own or are authorized to access each product, repository, property, account, domain, and dataset you connect.
BOD uses source-specific, read-only request policies. BOD does not modify code, repositories, analytics, billing objects, payment records, deployment environments, or external provider configuration. You must review any task before acting and must not give BOD credentials or data outside the requested connection flow.
Third-party services can change, suspend, rate-limit, revoke, or misreport access. Evidence may be delayed, incomplete, disputed, or unavailable. BOD displays quality states and may pause, correct, or withdraw a Daily Brief rather than invent a conclusion.
AI Coach and Prompt Artifacts
AI Coach narrates a deterministic, evidence-bound Quest Plan and may generate recommendations or Prompt Artifacts for tools such as Codex or Claude Code. AI output may be incomplete, inaccurate, unsuitable, or wrong even when it sounds confident.
You must independently review AI output, verify cited evidence and assumptions, protect secrets and personal data, test changes, and decide whether to use a recommendation. BOD previews and copies Prompt Artifacts only. It does not execute a Prompt Artifact, run a terminal, push code, merge a pull request, change infrastructure, publish content, contact prospects, or make a purchase for you.
Ownership and license
You retain ownership of your product, source code, trademarks, provider accounts, connected data, and other materials you supply. You give BOD a limited, non-exclusive license to process those materials only as needed to provide, secure, support, and improve the service under these Terms and the Privacy Policy.
BOD and its licensors retain ownership of the app, website, Season system, user interface, rules, software, documentation, branding, and other BOD materials. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use BOD for your own internal product-building activities.
Generated recommendations and Prompt Artifacts may be used for your product, subject to any rights or restrictions in third-party tools and content. We do not promise that AI output is unique or free from third-party claims.
Acceptable use
You may not:
- use BOD for unlawful, fraudulent, abusive, deceptive, infringing, or harmful activity;
- connect data you are not authorized to access or submit customer PII, secrets, or raw private code outside an approved connection boundary;
- probe, disrupt, overload, reverse engineer, bypass, or defeat security, entitlement, evidence, rate-limit, or Boss Gate controls, except where applicable law expressly permits;
- misrepresent self-payments, test payments, internal payments, fake users, or synthetic activity as product outcomes;
- use BOD to develop malware, evade provider rules, violate privacy rights, or make automated high-impact decisions about another person; or
- resell, sublicense, copy, or provide BOD as a competing hosted service without written permission.
Availability and changes
We may add, change, suspend, or remove features to maintain security, comply with law or provider rules, improve BOD, or respond to technical limits. We aim to preserve a purchased Season’s frozen rules and audit record. If a material outage prevents delivery, remedies will follow the checkout policy and applicable law.
We do not guarantee uninterrupted or error-free availability. Planned maintenance, provider incidents, network failures, model outages, API changes, and events outside our reasonable control may affect BOD.
Disclaimers
To the maximum extent permitted by law, BOD is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that BOD, connected evidence, benchmarks, AI output, recommendations, Expected Signals, or Prompt Artifacts will be accurate, complete, current, secure, available, or produce a particular result. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
Limitation of liability
To the maximum extent permitted by law, BOD will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, customers, opportunity, goodwill, or data; or the cost of substitute services arising from or related to BOD.
To the maximum extent permitted by law, BOD’s total liability for all claims arising from or related to the service will not exceed the greater of (a) the amount you paid BOD for the affected Season during the 12 months before the event giving rise to the claim or (b) USD 100. These limits do not apply to liability that cannot legally be limited.
Suspension and termination
You may stop using BOD at any time and may disconnect optional providers through the app or provider. We may suspend or terminate access when reasonably necessary to address a material Terms violation, fraud, abuse, security risk, legal obligation, non-payment, or provider restriction.
Termination does not erase accrued payment obligations or records that must remain for commerce, security, dispute, or audit integrity. Sections that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—will survive.
Governing law and disputes
These Terms are governed by the laws applicable where the operator of BOD is established, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply.
Before filing a formal claim, you and BOD agree to try in good faith for 30 days to resolve the dispute through the contact below. A claim may then be brought in a court with lawful jurisdiction. Nothing in this section prevents either party from seeking urgent injunctive relief or using a consumer or small-claims process that cannot be waived.
Changes to these Terms
We may update these Terms by posting a new version and effective date. Material changes will apply prospectively after reasonable notice. The version attached to a completed purchase and frozen Stage Contract continues to govern that purchase where the product contract says it is fixed.
If you continue to use BOD after updated Terms take effect, you accept the update. If you do not agree, stop using BOD before the effective date.

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will stay in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets. These Terms, the Privacy Policy, and the purchase-specific offer form the entire agreement about BOD.
